By electronically signing the online draw request ("Draw Request"), the Borrower requests the amount specified in the "Requested Draw Amount" for items outlined in the Sworn Construction Statement submitted by the Borrower.

TERMS & CONDITIONS

I. No defaults or Events of Default have occurred or are continuing under the Construction Agreement, Note, or any other Loan Documents associated with this project. No material adverse changes have occurred in the Borrower's financial condition since the Closing Date. II. Construction progress is on schedule according to the Construction/Payoff Schedule. The loan is in balance, and undisbursed proceeds, including the requested Advance, are sufficient to complete the Project. IIi. Labor, materials, equipment, work, services, and supplies listed in the Draw Request have been performed or furnished as per the Drawings and Specifications. IV. No material cost changes have occurred in the Project as outlined in the Sworn Construction Statement. V. All bills that could give rise to mechanic’s liens have been paid, will be paid from the requested Advance, or are not yet due. VI. All previous Advances have been used exclusively for the Project as specified, and no loan proceeds have been used for any other project. VII. The property has not been used as a residence since acquisition by the Borrower.
